Course Objectives
1. To acquaint chiropractors with the provisions of Title II of the Health Insurance Portability and Accountability Act of 1996.
2. To assist the chiropractor in assessing the impact of this legislation and related rules and requirements on their practice.
3. To help chiropractors develop an understanding of the changes in practice expected under the provision of the legislation and to offer methods of compliance with the legislation's rules.
4. To provide sample forms, policies, procedures, checklist and related tools to assist the chiropractor in customizing their compliance plans and efforts.
5. To provide chiropractors with appropriate reference materials regarding the legislation, the public rulemaking process and the related opinions of the Department of Health and Human Services (HHS) and the Office of Civil Rights (OCR).

Hour 1 |
Background information of the origins of the Health Insurance and Portability and Accountability Act of 1996 (HIPAA) and on the perceived needs that led to development of the legislation. Title II of HIPAA and the Administrative Simplification Act of 1999. The rulemaking process for the four areas of Title II (identifiers, transaction, privacy and security) will be discussed and the history of the rulemaking to date will be reviewed. Deadlines for the implementation of each of the four sections of Title II with specific emphasis on the Transactions and Privacy timelines |

Hour 2 |
The Privacy Rule (as amended August 14, 2002) reviewed with special emphasis on the “Privacy Notice” statement required of health care providers. Sample “privacy notice” statements tested against the requirements of the rules. Review of the “authorization” concept and related procedures. Requirements for a valid authorization and procedures associated with the appropriate use of authorizations. Sample authorizations for various chiropractic office procedures. |

Hour 3 |
Review the concepts of “minimum necessary” and “use and disclosure” as outlined in the Privacy Rule. Requirements for each concept reviewed with as examples of when and how each is best implemented. Developing of policies and procedures to implement the Privacy Rule. Expectations of practitioners regarding policy and procedure development, application, auditing and modification. |

Title II “identifiers” and “transactions” reviewed with discussion of the demands of HIPAA regarding to electronic transmissions.. The effect of the “transaction” requirements on processing of practice related third-party exchanges. Requirements of the legislation regarding “business associates.” Sample agreements addressing business associates circumstances. |
